制定《河南省艾滋病防治条例》的基本设想

为从根本上遏制河南艾滋病的快速流行趋势,有必要尽快制定专门的防治法规。通过文献查阅发现至今河南还没有专门的艾滋病防治法规。运用立法学方法,结合艾滋病本身的特殊性,笔者设定了《河南省艾滋病防治条例》。防治条例的内容主要包括立法目的、范围与主管部门、预防与控制、监测与疫情报告、治疗与救助、权利与义务、法律责任等。在制定条例时,应注意突出地方特色和提高立法质量。
