Taking typical medical cases as examples, this paper discussed the definition of the exercise of informed consent on behalf of patients through clarifying the relevant provisions of relevant laws on the exercise of informed consent and proxy exercise. The enlightenment is as follows: the exercise on behalf of informed consent should be limited and restrained by preconditions; the subject exercising on behalf of the agent includes close relatives or related persons and entrusted agents; the opinions of patients themselves have priority, and the opinions of entrusted agents should be given priority over those of close relatives.
