安乐死立法移植我国的可能性和必要性

通过对公开信息的收集和对特定群体的问卷调查等方式,分析了安乐死问题在中国面临的现状,认为其存在具有两大特点:第一是要求实施安乐死的人数呈高量性,第二是对安乐死持宽容、支持态度的人数呈多数性。我国立法机关对安乐死多年来持续采取的回避态度,无助于司法实践中这个困惑的伦理型法律难题的解决。可以肯定,在我国引进安乐死法律制度利远大于弊。当然,从技术层面来说,如何从国外引进安乐死法律制度,仍值得理论界的探入讨论。为确保安乐死制度不偏离该制度的预设目的,需要对安乐死措施作严谨的规范。安乐死法律制度应当存在自愿、适合法定条件、严格程序、无钱治病排除、冷静思考期设置、操作医生资质、安乐死种类法律限定和随时撤回申请权等重要的操作原则。

A Discussion on the Necessity and Feasibility of Introducing Euthanasia Legislation into China

In this article,the author first analyzes the current state of euthanasia issue in China and then comes up with the conclusion that the advantages of the practice of introducing euthanasia legislation into China from abroad far outweigh its disadvantages.Some basic principles of the practical operation and concerned mechanism for euthanasia are also discussed in order to avoid possible damage to justice.
