| 摘 要： | 为了更好、更有效地保护中药的知识产权,使国内中药产品走向国际市场,本文对中药品种保护和专利保护进行详细分析,比较中药专利保护和中药品种保护之间的优劣势,以便能够结合两者的优势,灵活运用这两种保护制度,达到最佳保护中药知识产权的目的.

| Abstract: | In order to better and more effectively protect the intellectual property rights of traditional Chinese medicine （TCM）,and make the products of TCM towards the international market,this paper gives a detailed analysis of the protection of and patent in TCM,the advantages and disadvantages between patent protection of TCM and the pro- tection of TCM varieties was compared in order to be able to combine the advantages of both,and flexibly apply these two protection system to achieve the best protection of intellectual property of TCM. |
