强化监督检查职能探讨

药品监管部门依法对相对人实施监督检查职能，是更好地履行行政职能和技术监督职能的重要手段。通过现场监督检查，可以对相对人起到事前预警和事后监督双重作用，笔者就结合近几年工作实践，谈几点看法。

在药品监督执法文书中，必须慎用模糊概念。无论是对管理相对人违法事实、相关证据的叙述说明，还是对处理依据、处罚建议、特别是处罚决定书等具有法律意义内容的叙写确认，一般不得应用模糊的语言概念。

在药品监督执法工作中 ,运用语言概念叙写药品监督执法文书是项常规性工作。在药品监督执法文书中 ,不管是对管理相对人违法事实、相关证据的叙述说明 ,还是对处理依据、处罚建议等具有法律意义内容的叙写确认 ,均要清晰明了 ,准确无误 ,不可含糊其词。在叙写药品监督执法文书时 ,凡涉及具有法律意义的内容 ,即管理相对人的药品生产企业、经营企业、医疗机构的违法事实、药品数额、违法时间 ,以及起着决定性作用的词语、语句 ,一般不得应用模糊的语言概念。其一 ,违法事实。这是依据《中华人民共和国药品管理法》(简称《药品管理法》) ,对管理相对人及药品生产、经营、使用单位的违法行为进行准确定性 ,及适用法律是否得当的重要证据之一。《药品管理法》第 9章法律责任共有 2 9条 ,其中就有 12条均有一个共同的规定 :构成犯罪的 ,依法追究刑事责任 ;该章第 99条规定 :尚不构成犯罪的 ,依法给予行政处分 ;第 95条规定 :情节严重的 ,对直接负责的主管人员和其他直接责任人依法给予行政处分。这就说明 ,准确叙写违法事实的情节、行为、性质等内容十分重要 ,一般不能使用模糊概念。同样是制售假劣药品 ,不但要写清其生产批次 ,还要写...     

论地方药品监督管理的机关依法行政

本文对药品监督管理机关如何根据法律授权，依法如何规范抽象行政行为，具体行政行为，以及加强法律法规知识学习和行政执法的监督等作了初步探讨，提出依法保障人民用药安全有效和用药合法权益应与依法保护药监行政管理相对人合法权益统一起来。     

有限法文，无限探讨——药品法的解释和适用

从宏观上看，2008年药品监管体制又在发生着新一轮的变革；但是从微观考虑，在建国以来的60年里，无论药品监管体制发生着怎样的变化，我们都有一支相对稳定的药品监督行政执法体系和执法队伍，特别是那些身处第一线的药品监督管理人员，他们每天进行着药品监督行政执法工作，每天在和行政相对人打交道，每天都在进行着认定事实、适用法律的工作。为此，有必要对“药品法的解释和适用”予以专题性的探讨。

药品监督抽验,是运用技术监督手段保障药品质量的重要措施。但客观分析近年来监督抽验的成效,却不能不令人忧虑。就药品领域而言,据笔者随机抽取某地30个县区近三年的监督抽验总结,有三个数字可以反映出当前药品质量抽验管理规定在基层实施的困境：一是上级给基层县区下达的药品监督抽验任务逐年递增,基本达到了行政相对人总量的10%以上。

Degraded and undegraded carrageenans and experimental gastric and duodenal ulceration

The prevention of histamine-induced gastric and duodenal ulceration in the guinea-pig has been examined using a series of undegraded and degraded carrageenans. Undegraded carrageenans were active at lower doses than degraded carrageenans. The high viscosity of the undegraded carrageenans in solution prevented their use in larger doses. Degradation of carrageenan without serious loss of sulphate, gives a product which allows the dose to be increased to an extent that its effect more than offsets the slight loss in activity caused by the degradation. No single feature of carrageenan structure can be related to anti-ulcer activity although degradation, and hence reduction of molecular size, generally reduces activity. Sulphate contents over 30% have little apparent effect on activity; κ-carrageenans were not consistently different in anti-ulcer activity from Λ-carrageenans. This contrasts with the antipeptic activity of carrageenans where κ-carrageenans are less active than their Λ-counter-parts. As with antipeptic activity, the degree of anti-ulcer activity is probably determined by a combination of structural features which includes molecular size and polyanionic properties.

Depression and anxiety frequently coexist in patients with substance use disorders. This clinically-oriented article examiens the relationship between these conditions and emphasizes data showing that substances of abuse can cause signs and symptoms of both depression and anxiety. These substance-related syndromes appear to have a different course and prognosis than uncomplicated, independent anxiety and major depressive disorders, and clinicians should consider the role of alcohol and other drugs in all patients presenting with these complaints. The authors will also outline an approach for diagnosing and managing patients with the combination of a substance use and depressive or anxiety disorder.

Glucosidase and fucosidase inhibitors and Advances in nucleosides and nucleotides.

The American Chemical Society Symposium "Glucosidase and fucosidase inhibitors" took place on 1 April 1998 and was organized by Professors Zbigniew J Witczak (UConn, School of Pharmacy, CT, USA), Kuniaki Tatsuta (Waseda University, Tokyo, Japan) and Waldemar Priebe, MD (Anderson Cancer Center, University of Texas, USA). Professor Witczak provided introductory remarks including the status of existing glucosidase inhibitors, and chaired the morning session, which consisted of six lectures. The symposium was well received, and was particularly attractive for those interested in networking, as attendance was about sixty. In addition, some participants and attendees presented posters on the subject during the regular poster session organized by the Division of Carbohydrate Chemistry.
