Deal in privacy case

The Denver District Attorney (DA) reached a plea agreement with a prostitute, Sandra L. Saunders. According to the terms of the agreement, Saunders will submit to an HIV test, the results of which will be shared with the district attorney. Prior to the agreement, the DA subpoenaed the State health department for the HIV records of Saunders, who has been arrested repeatedly for prostitution. Under Colorado law, if a person is convicted of a prostitution State charge, that individual must take an HIV test. The DA did not have any record of Saunder's test results because her prior arrests and convictions had been under city ordinances.     

Controversies in case management

A myriad of controversies exists around the provision of case management services in the private, public, nonprofit or insurance sector. As our population ages, it will be important for all of us to confront these issues as our profession continues to grow and inevitably change. In addition, it will be increasingly important, given the limited resources which will be available, for all sectors to join and work together to ensure that the needs of our older clients are met with services of the highest quality.     

Plea in exposure case

An HIV-positive Indianapolis man was sentenced to one year in a work-release program and one year on probation for having unprotected sex with two women. The man was jailed earlier this year for exposing a sex partner to HIV. In exchange for his guilty plea to two felonies of criminal recklessness, prosecutors dropped a misdemeanor charge of failure to warn. None of the women have tested HIV positive.     

Appeal in spitting case

The Ohio Supreme Court heard arguments in a bid to reverse a conviction of an HIV-positive man who spit at a police officer. Jimmy Bird was sentenced to 3 to 15 years for felonious assault because he used a deadly weapon, his saliva, to attempt to kill a police officer. He pleaded no contest to assault, but later appealed, saying no medical evidence showed that HIV was transmitted via saliva. A ruling is pending.     

Making a case for case management

In summary, medical case management promises great advantages to plan sponsors, providers, employees, and dependents if run well. Improved operations, communications and reporting involving all parties are still needed to make medical case management achieve its potential.     

Tragedy in moral case deliberation

In healthcare practice, care providers are confronted with tragic situations, in which they are expected to make choices and decisions that can have far-reaching consequences. This article investigates the role of moral case deliberation (MCD) in dealing with tragic situations. It focuses on experiences of care givers involved in the treatment of a pregnant woman with a brain tumour, and their evaluation of a series of MCD meetings in which the dilemmas around care were discussed. The study was qualitative, focusing on the views and experiences of the participants. A case study design is used by conducting semi-structured interviews (N = 10) with health care professionals who both played a role in the treatment of the patient and attended the MCD. The results show that MCD helps people to deal with tragic situations. An important element of MCD in this respect is making explicit the dilemma and the damage, demonstrating that there is no simple solution. MCD prompts participants to formulate and share personal experiences with one another and thus helps to create a shared perception of the situation as tragic. The article concludes that MCD contributes to the sharing of tragic experiences, and fosters mutual interaction during a tragedy. Its value could be increased through explicit reflection on the aspect of contingency that characterises tragedy.

医疗场所中的医患激烈冲突:澳洲的情况和对策

目的通过分析澳大利亚医疗市场案例激烈冲突的主要类型、归因和应对策略,为制定相应政策提供科学依据。方法文献和报告分析。结果医疗场所激烈冲突,主要直接归因于病人、医务人员、系统三方面,并与宏观系统有间接联系。澳大利亚的医患冲突主要发生在精神、心理和急诊服务场所。医务人员短缺和培训不足,医疗机构缺乏完善的员工和病人保护措施是医患冲突的主要系统因素。结论从导致冲突的直接原因入手,主要通过员工培训、加强保护措施和改善服务质量三方面,保护员工和病人安全。     

An organizational case study of the case manager's role in a client's return-to-work programme in Australia

The purpose of this study was to examine the case manager's role in a return-to-work programme in Sydney, Australia. The investigators examined the case manager's role assumed by occupational therapists, physiotherapists, psychologists and rehabilitation counsellors when providing occupational rehabilitation services. Files of closed cases (n=172) were examined to investigate the relationship between the case manager's profession and return-to-work outcomes. It was found that the provider of occupational rehabilitation examined in this study achieved above-average return-to-work rates (83%), with no significant difference between case managers. There was, however, a significant relationship between the client's type of injury and the case manager (p<0.001), and case length was significantly different between case managers (p=0.004).
