| 摘 要： | 与普通患者相比较，SARS患者自主择医权、隐私权、“人身自由”权和身体支配权等的行使都与社会公益原则发生一定的冲突，因此SARS患者的权利受到了限制。同时，SARS患者必须以社会公益为重自觉履行相应的义务，包括及时就医、详尽而准确地提供病史信息、病愈后自觉捐献血清回报社会以及积极配合和支持医学研究等。这就从一个侧面揭示了社会既要关注和保护患者的合法权益，又要充分认识患者权利与义务的具体实现具有相对性和灵活性。

| Abstract: | Some of the SARS patients' rights( such as self-determination, privacy, personal freedom and body eminent domain) and social commonweal principle conflict, which restricts a SARS patient's rights. Meanwhile the SARS patients must carry out their obligations to safeguard public interests. It's revealed from one aspect that the public not only pay attention to the patients' legal rights and interests but also understand the patients' rights and obligations are relative and flexible. |
