试论北京市医疗纠纷人民调解制度的完善

北京市医疗纠纷人民调解委员会自成立以来,在化解医疗纠纷、促进医患和谐方面发挥了一定作用,但仍存在法律依据有待强化、法律性质有待明确、受案范围有待厘清、保险公司的角色与功能有待科学设定等问题。为此,提出应高度重视行业性、专业性组织的作用;加强北京市医疗纠纷人民调解制度的法律与制度建设;健全医疗责任保险制度,科学设定保险公司在调处程序中的角色与功能等完善北京市医疗纠纷人民调解制度的建议。

Discussion on the improvement of People's Mediation System for medical disputes in Beijing

The people’s mediation committee of medical disputes of Beijing has played an important role in resolving medical disputes and promoting the harmony between doctors and patients since its inception.However,there are still some shortcomings needed further improvements.In details,the legal basis needs to be strengthened;the legal nature needs to be clear;the scope of accepting case need to be to clarified and the roles and functions of insurance companies need to be set scientifically.In future,more attention should be paid to enhance the role of professional organizations,to strengthen the legal and institutional construction of people’s mediation system of Beijing for medical disputes,to improve the medical liability insurance system,to set scientifically the roles and functions of insurance company in the mediation process.
