| 摘 要： | 专利技术的二次开发可以在基本专利的基础上获得从属专利,使企业在某项技术领域中取得技术上的主动权。中药专利技术的二次开发思路主要有选择技术领域、专利检索、寻找开发点和形成新的技术方案4个步骤,同时在方案设计中要注意原专利的性质、论证和实施许可等问题。

| Abstract: | The second development of patent technologies may bring about the subsidiary patents of them on the basis of the original patents so that enterprises are able to take inetiative in the field of technology. The thinking of the second development of patent technologies for Chinese medicine principally consists of the following four steps: the choice of technical areas, the retreaval of patents, the exploration of development points and the formation of new technical scheme. In the meantime, attention should be paid to the nature and demonstration of the original patents as well as the license of their implementation. |
