浅谈少数民族传统医药知识产权的国际保护

基于我国少数民族地区特殊的气候条件、地理环境和医学理论,各少数民族的传统医药在治病扶伤方面各有所长,其中的一些著名方剂疗效显著,至今仍有巨大的利用价值。随着我国加入WTO和国际经济活动的增多,在国际上保护少数民族传统医药的知识产权也愈显重要。我们可以通过专利权,商业秘密,商标权和地理标志等法律方法寻求对知识产权的域外保护,也有必要通过行政模式和特殊的知识产权保护途径,保障少数民族传统医药的知识产权在国际上不受侵害。

International IPR Protection and Related Strategies for Traditional Medicine of Chinas ethnic minorities

Due to the special climate,geographical conditions and particular traditional medical theories,the ethnic minorities in China have their respective advantages in medical treatment.For the notable pesticide effects,some of the traditional medicines still have great value in health care and industrial manufacturing today.As our country has entered WTO and the number of global economic activities increases,it becomes more and more important to protect the IPR of the ethnic minorities＇traditional medicine.We can seek foreign protection through legal means such as patentability,commercial secret,trademark and geographical indication;on the other hand,it is also necessary to protect IPR from foreign damna through administrative and other special means.
