| 摘 要： | 文章结合《中华人民共和国电子签名法》?《电子病历基本规范(试行)》等法律规范,对电子病历的合法性?电子病历的证据能力?电子病历的证据特征等三个问题进行了较为全面的阐述,并初步探讨了电子病历实践中约定使用?电子签名?患者隐私权保护?电子病历的可溯性?

| Abstract: | Combination of the Electronic Signature Law of the PRC,the Basic Norms of Electronic Medical Records (Trial) and other laws and regulations,the authors systematically expounded three legal issues of electronic medical record:the legality,the evidence of qualifications,characteristics of evidence of electronic medical records,and then preliminarily discussed the agreed use of electronic medical record,electronic signature,patient privacy,and the traceability of electronic medical record. |
