我国医患纠纷第三方调解的发展与趋势

对医患纠纷及医患纠纷第三方调解的概念和要素进行了阐释,以时间为轴线,将我国第三方调解的发展分为萌芽期、探索期、发展期、认可期并分别概述;总结我国医患纠纷第三方调解的变化特征：政府主管部门从卫生部门变为司法部门、调解从收费变为免费、经费从困难变为政府财政支持、模式从单一趋向多元化。提出优化医疗责任保险运行机制和制定专属医患纠纷处理法律的建议：不断优化医疗责任保险运行机制,建立专属于医患纠纷的法律条例,统一第三方调解机构调解结果的法律效应。

The Development and Trend of the Third Party Mediation of the Doctor-patient Dispute in China

In this paper, the authors explained concepts and factors on medical dispute and the third party mediation of medical dispute. We took time as the axis, and divided the development of the third party mediation of our country into four periods ： bud period, exploration period, development period and recognition period, then elaborated respectively. The author summarized the characteristics of changes of the third party mediation of medical disputes in China, most of which are shown as follows： the competent department transformed from the Health Department to the Justice Department, media- tion varied from charging to being free, operating expenses changed from shortage to having financial support of the govern- ment, and the model altered from single to diversification. Suggestions are put forward that the medical liability insurance mechanismshould be optimized and exclusive medical dispute law should be established constantly optimize the operational mechanism of medical liability insurance, set up exclusive rules in doctor-patient dispute, unify the legal effect of the third party mediation organization.
