| 摘 要： | 民法中因果关系的判断长期困扰着法学理论和司法实践。由于医疗行为的诸多特殊性，医疗侵权中的因果关系更显得扑朔迷离。在分析借鉴一般民事侵权行为的各种因果关系认定理论的基础上，主张采用因果关系两分法，并在此基础上探讨医疗侵权中因果关系的判断。 |

| Abstract: | The judgment on causality in civil laws has perlexed the scholars and courts for many years.Due to the particularities of many kinds in medical services,the causality in medical malpractice seems even more complicated and confusing.On the basis of analysing and referring to the various kinds of causalities in tort,this article advocates the causality dichotomy,and further discusses the judgment on causality in medical malpractice. |
