| 摘 要： | 作为医学领域的一个基本伦理原则,医师的说明义务起源于英美法系的"Inform ed Consent"理论,并且主要是在美国的判例中形成的。在美国,主要是以"侵权行为"对"告知后同意"理论进行规范,并经历了从故意伤害到过失侵权的法理演变过程。 |
