论我国中医药法律层面专门立法——国外的经验与启示视角

目的进一步完善我国中医药法制,促进并规范中医药事业发展。方法比较研究,通过考察其他国家包括中医药在内的传统医药立法及法律保障实施机制的经验。结果我国应尽快出台专门中医药法律。结论该法律调整对象应涵盖中医药各个方面,特别是中药监管、知识产权与文化遗产保护、中医药行政程序与救济机制等;该法还应对其实施保障机制予以充分规定,包括组织保障、财政资金保障、配套制度体系保障等方面。

Research on China''''s Lawmaking of Chinese Medicine:A Perspective of the Foreign Experience and Inspiration

Objective To improve the Chinese Medicine legal system and advance Chinese Medicine industry.Methods The foreign practices and experiences were reviewed by comparative method.Results Special law of Chinese Medicine should be made as soon as possible.Conclusion All regulating objects should be included in the law of Chinese Medicine,especially those of Chinese drug,intelligent property,traditional knowledge,the administration procedures and remedy mechanism and so on.Besides,the law should also prescribe protection system for conducting itself sufficiently,which should include organization safeguard,financial fund safeguard and other relevant mechanisms.
