论中医药知识产权的刑法保护

中医药作为中华民族的文化瑰宝,需要严密的法律保护。刑法作为整个法律体系中的最后保障法,对于侵犯中医药知识产权的犯罪行为进行调整是必要的,同时应遵循一定的适度性原则。我国现行刑法中有关知识产权犯罪的规定存在着一定的疵漏,不利于对于侵犯中医药知识产权犯罪的刑事惩治。因此在理论上对我国中医药知识产权刑法保护的现状进行检讨与反思,并适时对知识产权犯罪的刑事立法进行完善是完全必要的。

Discussion on the Criminal Law Protection of the Intellectual Property Right of the Traditional Chinese Medicine

With the intellectual economy age arriving,all of the world strengthens the protection of the intellectual property right.As the traditional Chinese medicine is the treasure of China,it needs more protection of law,and as the last safeguard law of the entire law system,the adoption of the criminal law is necessary.At the same time,it must be keep to moderation principle.Because of some imperfects in the regulations of the intellectual property crime in the Chinese criminal law,it is not beneficial to penal the Chinese traditional medicine intellectual property crime.Therefore,it is necessary to analysis and considerate the status of the protection of Chinese traditional medicine intellectual property from theory and to consummate the imperfects in the criminal law.
