| 摘 要： | 最高人民法院在《关于民事诉讼证据的若干规定》中,首次将医疗侵权案件列入"举证责任倒置"的范畴。文章分析了新的证据规则对医疗侵权诉讼的影响,并结合参与医疗侵权诉讼的经验,提出了在诉讼中构建"专家辅助人"制度的设想。

| Abstract: | A number of the stipulations about the Civil Action's Evidence,which is adopted by the Supreme People's Court of the PRC,makes the medical tort be paced on the extent of Inverting Burden of Proof in the first time.The author analyzes the recent evidence rule in this paper to the medical tort influence,and the unionparticipation the medical tort experience,proposed constructs"the expert assistant"in the lawsuit the system tentative plan. |
