甘肃省中医药工作中的地方立法研究

甘肃省近几年出台了一系列的支持中医药事业发展的政策,在医改中充分发挥中医药的作用,促进了甘肃省中医药事业发展。但是,由于相关发展政策和措施比较分散,不能统筹、协调中医中药全面发展,制约了甘肃省中医药事业发展,因此迫切需要对中医药工作中的相关政策进行地方立法研究。本文通过对甘肃省在中医药工作中地方立法必要性、可行性分析,认为甘肃省实施中医药发展战略符合＂促进型立法＂的特点,应在结合地域特色的基础上,遵循强化重点、全面协调的原则、注重可操作性,针对法规具有的稳定性、权威性和规范性特点,制定完善的、稳定的中医药发展战略规划。

Study on Local Legislation of Traditional Chinese Medicine Development Policy in Gansu Province

In recent years, Gansu Province introduces a series of policies to support the development of traditional Chinese medicine, and gives full play to the role of the traditional Chinese medicine in the health reform, which actively promotes the development of traditional Chinese medicine in Gansn province. However, due to relevant development and measures are relatively dispersive, which can＇ t coordinate the＇ all - round development of traditional Chinese medicine, and at the same time confine its development in Gansu province. Therefore, there is an urgent need to make this policy legislated. Through the analysis of necessity and feasibility, this paper suggests the local legislation of traditional Chinese medi- cine policy accords with characteristics of active legislation. Based on geographical characteristics, given that law has the characteristic of stabili- ty, authority and normativity, principles of strengthening the key and comprehensibly coordination should be followed, operability should be em- phasized, mature and stable strategic planning for traditional Chinese medicine development should he made.
