司法精神病鉴定的随访研究

目的研究司法机关、案件双方当事人或其亲人以及周围群众对鉴定结论的满意度、接受度。方法分别用司法精神病鉴定随访调查问卷,采用面访与信访结合的方式,对司法机关、案件双方当事人或其亲人以及周围群众进行随访。结果司法机关对鉴定结论的采纳为100％;鉴定结论与最后的司法判决：70例（83．33％）一致,14例（16．67％）基本一致。对鉴定结论,司法机关满意度最高（100％）,案件相关的当事人或受害人最低（70％）。随访发现,NGRI者未治疗率高达52．17％,再犯案率为17．39％。结论司法机关对鉴定工作的接受度和满意度较高,而案件相关的当事人或受害人偏低。NGRI者的治疗率较低,再犯案率高。

Following-up study on forensic psychiatry expertise

Objective To investigate sense of satisfaction and acceptance in the expertise by the judicial departments, both parties of a case and the masses. Methods By means of interview of face to face and letter, the judicial departments, both parties of a case and the masses were followed up by following --up questionnaires of forensic psychiatry expertise. Results The judicial departments wholly adopt the expertise. 83.33% of the conclusion is totally accordant with the final judicial verdict. 16.67% is basically accordant. Regarding to the expertise, the judicial departments have a high rate of satisfaction （100%）, but both parties of a case and the victims have relatively low rate of satisfaction （70%）. Furthermore, the rate of untreated NGRI is high （52.17%）, and the rate of new crimes and rearrested is high （17.39%）. Conclusions The acceptance and satisfaction in the expertise are higher in the judicial departments, but lower in both parties of a case and the victims. The rate of treated NGRI is low, resulting in a high recommitment rate.
